Terms and conditions

These Terms govern access to Zesty, a restaurant operations platform for QR ordering, staff ordering, POS workflows, kitchen display, billing, payments, inventory, customers, staff access, analytics, mobile workflows, support, and related services.
By creating an account, administering an organization, using a restaurant workspace, placing an order through a public customer flow, or accessing Zesty in any other way, you agree to these Terms.
Accounts and authority
Users must provide accurate information, keep credentials secure, and use Zesty only for lawful restaurant operations. Organization owners and admins are responsible for inviting users, assigning roles, reviewing permissions, enabling security controls where appropriate, and removing access when staff leave.
If you create, administer, or pay for an organization, you confirm that you have authority to act for that restaurant, brand, franchise, outlet, or operating entity.
Platform role
Zesty provides software tools. Zesty does not operate restaurants, prepare food, employ restaurant staff, provide accounting, legal, tax, food-safety, employment, or business advice, or act as the merchant of record unless a separate written agreement says so.
Restaurants are responsible for their own menu legality and accuracy, item images and descriptions, prices, taxes, invoices, GST and FSSAI details where applicable, customer notices, order fulfillment, food quality, staff actions, refunds, disputes, exports, communications, and compliance with food-service, consumer, tax, payment, privacy, employment, and other applicable obligations.
Customer ordering and operations
QR ordering, public ordering, staff ordering, table sessions, reservations, POS, kitchen display, billing, payment requests, refunds, customer feedback, inventory, analytics, mobile workflows, and support tools must be used only for legitimate restaurant operations.
Restaurants should verify menu availability, tax settings, payment modes, payment-provider setup, customer-facing information, staff permissions, table QR codes, and branch context before live service.
Zesty may provide estimates, reports, analytics, tax breakdowns, inventory signals, recipe projections, or operational suggestions. Restaurants must review those outputs before relying on them for financial, tax, staffing, procurement, legal, compliance, or business decisions.
Subscriptions, trials, and paid features
Paid plans renew according to the billing terms shown at checkout or in a written or manual commercial arrangement. Access to paid features depends on successful payment capture, valid provider subscription status, correct plan mapping, active organization status, and applicable entitlement rules.
Zesty may grant temporary trial access for evaluation. Trial grants are discretionary, may expire automatically, and may be revoked for misuse, security risk, non-payment, or operational reasons. A trial grant does not waive payment obligations for active paid subscriptions unless Zesty confirms that separately in writing.
Zesty may suspend, cancel, downgrade, or restrict paid features for failed, cancelled, expired, refunded, disputed, unmapped, abusive, or suspicious payment activity.
Payments and providers
Payment providers such as Razorpay and other configured providers may process subscriptions, restaurant payments, refunds, payment verification, reconciliation, and related data under their own terms.
Restaurants are responsible for payment settlement, reconciliation, UPI review, chargebacks, disputes, provider dashboard actions, customer refund promises, tax invoices, and any payment instructions they provide to customers or staff.
Provider outages, delayed payment capture, webhook delays, invalid plan mappings, failed verification, or incorrect restaurant configuration may delay access to paid features or order payment confirmation until the correct state can be verified.
Customer communications
Restaurants are responsible for obtaining and maintaining any required consent or lawful basis before sending SMS, WhatsApp, email, phone, receipt, campaign, loyalty, or feedback communications through Zesty or connected providers.
Restaurants must not use Zesty to send spam, unlawful marketing, misleading messages, or communications that violate provider policies or applicable law.
Data, uploads, and integrations
Restaurants control the operational and customer data they enter into Zesty. Zesty may process data through third-party providers for hosting, database, storage, authentication, email, messaging, payments, analytics, monitoring, security, and support as described in the Privacy Policy.
Restaurants are responsible for configuring and maintaining connected services, credentials, webhooks, tax settings, outlet details, staff permissions, exported files, imported files, uploaded assets, and downstream systems where they send Zesty data.
Uploaded files, menu images, support attachments, and white-label assets must be lawful, relevant, safe, and authorized for restaurant use.
Support access
Eligible organization owners or admins may create support tickets, reply to ticket threads, attach relevant files, and allow audited support access where available. Attachments must be lawful, relevant, and free of malicious content.
Zesty may refuse support access, attachments, or requests that are unsafe, abusive, unrelated, excessive, unlawful, or missing necessary context.
Acceptable use
Users must not attempt unauthorized access, bypass tenant or branch boundaries, scrape or exfiltrate data, upload malware, disrupt service reliability, abuse APIs, overload images or storage, misuse payment or messaging systems, send unlawful communications, impersonate others, manipulate plans or entitlements, interfere with monitoring, or use Zesty for fraudulent, illegal, or harmful activity.
Zesty may rate limit, block, challenge, suspend, downgrade, or terminate activity that appears abusive, automated, unsafe, harmful, or risky to platform reliability.
Changes to service
Zesty may change features, pricing, plans, limits, providers, APIs, integrations, security controls, support workflows, mobile behavior, docs, and product surfaces as the platform evolves.
Preview, test-mode, beta, experimental, or connector-specific features may not be suitable for production use and may change or stop working without the same notice as generally available features.
Suspension and termination
Zesty may suspend, restrict, downgrade, or terminate access for non-payment, security risk, misuse, legal risk, suspected fraud, provider issues, violation of these Terms, or organization lifecycle states such as suspended or archived.
Some records may be retained for audit, billing, tax, support, security, backup, fraud prevention, dispute, or legal reasons after suspension or termination.
Warranty and liability
To the maximum extent permitted by applicable law, Zesty is provided without warranties beyond those expressly agreed in writing.
Zesty is not liable for restaurant operations, food quality, customer disputes, staff misuse, inaccurate restaurant-entered data, tax filings, accounting decisions, provider outages, lost profits, indirect damages, business interruption, or misuse of the platform by restaurants, staff, customers, or third parties.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
Indemnity
Restaurants and organization owners agree to defend and hold Zesty harmless from claims, losses, penalties, costs, and expenses arising from their restaurant operations, customer interactions, staff actions, menu and pricing information, taxes, food safety, communications, exports, integrations, payment disputes, unlawful use, uploaded content, or breach of these Terms, except to the extent caused by Zesty's own non-excludable legal responsibility.
Governing law and jurisdiction
These Terms are governed by the laws of India. Subject to any mandatory dispute resolution requirements under applicable law, competent courts in India will have jurisdiction over disputes arising from or relating to these Terms, Zesty, or use of the platform.
