Data Processing Agreement

This summary explains Zesty's practical data processing position for restaurant workspaces. It is intended to support customer review and should be read with the subscription agreement, Privacy Policy, Terms, Subprocessors page, and security documentation.
Roles
For restaurant customer, staff, order, CRM, supplier, inventory, loyalty, campaign, and operational data, the restaurant generally decides why and how the data is processed. Zesty provides the software platform and processes that data according to the subscription agreement, product settings, lawful restaurant instructions, and applicable law.
For Zesty SaaS account, subscription billing, platform security, support operations, and platform analytics, Zesty may act as the Data Fiduciary/controller for the relevant account and service data.
Processing commitments
Zesty will use restaurant workspace data to provide, secure, support, maintain, troubleshoot, and improve the Zesty service. Zesty will not sell restaurant customer data and will not use restaurant customer data to fabricate marketing claims, fake testimonials, or fake usage metrics.
Restaurant responsibilities
Restaurants remain responsible for their customer and staff notices, lawful collection, marketing consent, staff monitoring notices, exported data handling, food-service operations, tax records, and requests from their own customers and staff.
Subprocessors
Zesty uses providers for hosting, databases, storage, payments, email, messaging, analytics, monitoring, support, and AI where enabled. See Subprocessors for the current vendor categories.
